What A Dump!

Beyond The Forest of Legal Documents We’re fighting clutter here; no easy feat. A week out from opening statements is as good a time as any for another document dump.   These have been laying around a while and we’ve done our level best to mine them for nuggets, never quite knowing for certain where a headline may...

That Dog Don't Hunt

Muzzling the Cadaver Dogs Although the odds of getting evidence and ‘testimony’ from the cadaver dogs who searched the murder scene were slim, it’s now official that none of their findings will make it into the trial. The original affidavit said the dogs altered (to human blood or remains) at two spots at 1509; the patio drain and...

Advice and Consent

Zaborsky Withdraws Motion to Suppress An interesting consent motion ran across the clerk’s desk late Friday afternoon, but because the District of Columbia was celebrating Emancipation Day the Courthouse was closed.  And perhaps ironically, this filing may be evidence of Victor Zaborsky trying to free himself. It appears that Zaborsky’s counsel Thomas Connolly, or a lower...

Gorilla Dust

Kicking Up Distractions Before the Court.  Why It Matters In modern times it dates back to December 15th, 1991.  H. Ross Perot – remember him? – then a member of the General Motors board, parried with GM CEO Roger Smith’s optimistic perspective of GM’s future.  Distilling Smith’s rosy sales pitch, Perot scooped imaginary dirt and...

Opposition Friday

Government Quotes the Defendants’ Words Back At Them The Government responded earlier this week, not surprisingly, in opposition to the separate defense filings to suppress the defendants’ statements they gave the night of the murder from being entered at trial.  In doing so, AUSA Glenn Kirschner revealed new details about what Joe did immediately after finding Robert’s...

An Attorney Unloads on the Trouple’s Defense, and the Prosecution’s Hubris From the start we’ve worked to cultivate a deep pool of experienced opinion.  Blood spatter analysts, medical toxicoligists, psychological therapists, homicide researchers, forensic psychologists…and, of course, lawyers. We continue to welcome their thoughts and contributions, where-ever it may take us. Today, a new addition. Recently we...

Hocus Pocus

Kirschner Pulls A Couple Rabbits Out Of His Hat With the May trial looming just weeks away, we’re trying to stay current with the latest motions and filings.  Not always easy given the challenges posed by DC’s stone age system of court document storage and distribution. Hitting the clerk’s office last week was the government’s slim...

Government In Action We’re getting close to Go Time.  We have every reason to believe the trial will be gaveled in on time, just about five weeks from now on May 10.  Both sides have been following Judge Leibovitz’ scheduling order and are getting their motions and responses filed, mostly on time.  Two critical pending issues...

"Do I Need A Lawyer?"

"Do I Need A Lawyer?"

Joe Price May Find Out At Today’s Status Hearing.   At the January 15 status hearing, Judge Lynn Leibovitz set several deadlines for both sides to hit.  The result?  Motion after motion after motion.  In January, Leibovitz denied the Motion to Dismiss just days after getting the papers; warp speed compared to her predecessor.  A lot...

Uncharged Conduct, and Michael Price Uncharged…Yet Hewing to Judge Lynn Leibovitz’  scheduling order, the prosecution has met their first deadline.  The government’s filing of “Uncharged Conduct I” was due on February 5th and was made public Tuesday, Feb. 16th… just a few days after Valentine’s Day.  This was no Whitman’s Sampler to the defendants. “Given the...

Purpose of this Site

On August 2nd, 2006, Washington attorney Robert E. Wone was murdered at 1509 Swann Street. Over two years passed before any criminal charges were filed - and then only conspiracy, obstruction of justice and crime scene tampering charges were brought against the Swann Street housemates, all present in the home on the night of the murder: Joe Price, Dylan Ward and Victor Zaborsky.

On May 17, 2010, a DC Superior Court trial got underway and all three defendants were all acquitted in that bench trial on those pending charges.

Nearly four years later, very little seems clear about what happened that night and who murdered Robert Wone. A cloud of suspicion remains over the Swann Street defendants who have denied any involvement in the murder of their friend or in the alleged cover up.

Judge Lynn Leibovitz found a moral certainty in their collective guilt, but not evidentiary certainty. Civil proceedings in a wrongful death suit filed by Robert's family is the next chapter in this tragic story.

We continue to work together seeking answers to the mystery of Robert Wone's murder and in finding justice for his memory and legacy.
