Government In Action

We’re getting close to Go Time.  We have every reason to believe the trial will be gaveled in on time, just about five weeks from now on May 10.  Both sides have been following Judge Leibovitz’ scheduling order and are getting their motions and responses filed, mostly on time. 

Two critical pending issues are Defense motions to Sever and Suppress  (Mirandas).  Both may be decided on by the time of the next (and final?) status hearing on Monday, April 5.

Just hitting the Superior Court Clerk’s office late this week were two Government filings regarding these motions.  We’ll be posting these early next week:

Government’s Consolidated Response to Defendents’ [sic] Motion to Sever

Government’s Omnibus Opposition to Defendents’ [sic] Motion to Suppress Statements

I’m clearly the last one who should be pointing out spelling errors, but somewhere between the  US Attorney’s Office and the Clerk, someone isn’t squared away on the proper spelling of “defendant.”

Hmm, it appears one might make a tidy sum as an editor in our fair capital.

Again I ask: Can no one afford MS Word in this economy? Or have they never gotten farther than selecting the perfect font for their email signatures?

Unfortunately, no. There is no “tidy sum” to be made as an editor. Sadly, it seems proper grammar and correct spelling no longer matter.

yes it is odd, because I typed in “defendent” and MS Word autocorrected it to “defendant”. But, I am fairly certain the US Attorney’s Office uses WordPerfect, so maybe that does not auto correct…

Omnibus, I assume, refers to the prosecution responding to the trio as a collective entity rather than as individuals. Nevertheless, whether or not the trouple is still a united front in reality remains an open question. Commitment rings aside, who really believes that Joe and Victor are sharing any intimacies, let alone a bed? Dyl is already sexually independent, thanks to his work contacts. Aunt Marcia, give us the dirt!

As for Miranda (not Carmen), Lynn as a Bush appointee does not strike me as a Warren court apologist or absolutist. While the Bushies may have cynically used ’60s rhetoric in thwarting ’60s goals — “no child left behind” comes to mind; “color-blind” admissions is another, they have very little love for defendants’ rights, that is, until they themselves are indicted. Bottom line: the requests for suppressions based upon Miranda will be mercifully suppressed! Score another one for the Gipper, the grandfather of our present law and order regime!
